Actually, unless he was unaware that he was a diabetic, the fact that he may have been having a diabetic reaction only establishes the requisite mens rea. After all, if he knew of his condition, he was aware of the effect not eating could have on him. Thus, getting into a car without ensuring an appropriate blood sugar level was tantamount to getting into a car with elevated BAC levels. And unless you are George W. Bush, you don’t get off because you were drunk when you broke the law.
